  • In re Robert K. Miell, United States Bankruptcy Court, Northern District of Iowa, Case No. 09-01500. Successfully represented three secured lenders, among larger group of creditors, in obtaining conversion of Chapter 11 case to Chapter 7, obtaining relief from automatic stay with respect to over 60 properties, and acquiring those properties via credit bid sales under Section 363 of United States Bankruptcy Code.
  • Park National Bank v. H-N-W Associates, LP, et al., Iowa District Court, Linn County Case No. EQCV 56321. Successful foreclosure of real estate and ground lease mortgage relating to 63 acre regional two-story in-line retail shopping mall having approximately 628,000 net leaseable square footage.
  • United Fire & Casualty Company v. Swiss Reinsurance America Corporation, Iowa Court of Appeals, Case No. 4-476/03-0715. Successful appellate reversal of district court ruling finding that client had waived attorney-client privilege with respect to knowledge of in-house counsel and ordering in-house counsel to testify as to same.
  • American Ordnance v. Welcher, Iowa Court of Appeals, Case No. 5-872/04-1045. Successful appellate affirmance of district court ruling holding that former employee of United States military munitions manufacturer was precluded under state and federal law from pursuing action for alleged breach of state private workplace drug testing laws.
